Please go through our terms and conditions carefully before posting your Mobile Phone Ma. By submitting your sale order, you agree to be bound by these terms and conditions. Our website is only intended for use by people registered with us and resident in Great Britain and Northern Ireland. At our complete discretion we may accept or reject orders from people outside of these territories. You are at least 18 years of age (or if under 18 years, have received permission from your parent/guardian) and that you are able to enter into a binding contract. We are not responsible for any liabilities or claims resulting due to a breach in any of our terms and conditions.

Phone Classification:

The Mobile Phone Market which is sold must be same as the make and model mentioned in the sale order and must meet the conditions given below:

Brand New Mobile Phone Market:

  1. The screen seal is present and has not been tampered with.
  2. There are absolutely no marks or scratches on the phone.
  3. All accessories are present and unopened.
  4. The original box is in good condition.
  5. The IMEI on the box matches that on the phone.
  6. Call timer on the phone is zero and there is no data inside the phone.
  7. No calls have been made or received.
  8. The Box of the phone should be of original manufacturer, not generated or white box.
  9. The phone should not be at any case a refurbished or a reconditioned one.
  10. Memory card should be included if supplied by the manufacturer of service provider.

Used Working Mobile Phone Market:

  1. The phone can be turned on and off and make/receive calls
  2. The LCD screen / touch screen is full and fully functional.
  3. The screen is intact (no cracks, no dead pixels).
  4. The phone free of any PIN, be removed from any iCloud / Samsung / Google Accounts
  5. Do not have missing parts (including the battery and the back cover).
  6. The phone has all original parts.
  7. Not be water-damaged (water indicators must not be pink/red)
  8. Must NOT be reported as barred / Blacklisted / Stolen.

Used Non-Working Mobile Phone Market:

  1. Please note that due to possible iCloud issues we do not accept any iPhones that do not switch on
  2. The phone must turn on and / or off.
  3. The LCD screen / touch screen is faulty or not working.
  4. The screen has spots, damaged or dead pixels.
  5. The glass front panel is cracked.
  6. Missing some of its constituent parts (battery and / or back cover).
  7. The cursor key is not present (on Blackberry phones).
  8. The SIM card locked phone or the by operator.
  9. The phone has scratches and dents.
  10. Be intact - not crushed or snapped in half
  11. Be removed from any iCloud / Samsung / Google Accounts

Damaged Mobile Phone Market:

Damaged Mobile Phone Market must power up to receive the full displayed value on our website. If they fail to power up or show any signs of life we will send you a revised offer.

Where possible, we offer value for a damaged Mobile Phone Market, but shall not be obliged to do so nor purchase any damaged Mobile Phone Market. Damaged Mobile Phone Market will be traded using the same process as for all other Mobile Phone Market. If we determine your Mobile Phone Market is damaged, we may, at our discretion, pay for the damaged Mobile Phone Market but the value will be as indicated on our website. Accordingly, if a Mobile Phone Market that we receive is damaged, then we will value the Mobile Phone Market to take account of the damage and send a revised value by email.

In some cases, values will be zero if Mobile Phone Market are beyond economical repair or have multiple faults (e.g. water damage and cracked LCD screen). A revised value will only be given once the Mobile Phone Market has been tested or inspected. You can decide whether to continue with the revised sale or whether to decline it. To accept of decline a revised value, either reply back to the revised offer email or contact us via telephone.

If you do not respond within 5 days, starting on the day on which we email the revised value, we will automatically process your Mobile Phone Market sale after that time using the new price. Mobile Phone Market in pieces or parts or Mobile Phone Market that have no value, will not be returned and we may recycle or dispose of them at our discretion.

We will not pay if:

  1. The phone is water damaged, beyond economic repair.
  2. Model copies, stolen, prototypes or models unsuitable for sale.
  3. Phone with front panel broken or cracked glass.
  4. Phone is severely damaged.
  5. Phone is devoid of keyboard and / or LCD screen.

Before posting your Mobile Phone Market to us, please make sure you do the following:

Read these terms and conditions carefully

Make a note of your phones IMEI number, the IMEI number is unique to each phone and can always be used to track your handset. The IMEI number can be found by typing *#06# into your phone's dialling screen. Remove all personal files e.g. images, messages, emails etc. before sending your Mobile Phone Market. We are not responsible for your private information. Any phone received that has not been wiped of data will be erased before we start the grading process. Remove all SIM and memory cards before sending your Mobile Phone Market - Any SIM or memory cards received by us will be destroyed and we are not liable for any charges incurred if a SIM has been sent to us. It is your responsibility to terminate any contracts associated with your phone, ensuring any contracts have been honoured, failure to make payments on a handset contract will lead to it being blacklisted and we are unable to accept any phone that has been blacklisted. Remove any activation locks, iCloud, Samsung or Google accounts associated with Mobile Phone Market, this is very important as we will be unable to process your order until the accounts are removed. Have any any PIN, password or screen locks, ‘Activation Lock’ or iCloud Lock deactivated and removed prior to shipping - if any lock is enabled, we won’t be able to test the phone as we will be unable to access any of the functions and the phone will be deemed inoperable. Therefore, we will only be able to offer you 5% of the value. Ensure the Mobile Phone Market is not blacklisted or reported stolen or lost, you can check this using the CheckMEND database, www.checkmend.com.

Submit an order on our website, after which you will receive a quote from us, a free postage label or a sales pack in the post. The information on the order form must be accurate, or else you may not receive the full estimated price. Not be ‘jail-broken’ or have similar firmware alterations

Be in its original manufactured condition (i.e. no replacement parts)

Not be crushed, bent in half or heavily liquid damaged, be complete with no missing parts including battery / battery cover

How is the Contract formed?

By clicking ‘Confirm Your Order’ you are offering to post your Mobile Phone Market to us for the price set out on our website.

Please note that any obligation we may have to pay for your Mobile Phone Market is conditional upon it passing our Quality Assessment.

As payment for your Item:

If your Item passes our Quality Assessment, we will pay you the amount of the Valuation;

Or

If your Item does not pass our Quality Assessment, we may pay you the amount of our revised Valuation or we may arrange for your Item to be Recycled, as set out in conditions 15, 16, 18 and 19.

If you do not agree to the Terms and Conditions dealing with revaluation and Recycling of your Item, then you should not place your order on our Website or send us your Item.

Nothing in these Terms and Conditions shall affect our right to revise the Valuation of your Item if your Item does not pass our Quality Assessment.

Postage & Packaging

  1. Before you post your Mobile Phone Market, it is your responsibility to make sure it is physically protected through proper packaging and is insured against any possible loss or damage in transit.
  2. Please make sure you obtain proof of postage and a tracking number till payment is processed on your sale order.
  3. Royal Mail will only deliver two or more phones if sent by special delivery. Unfortunately, other than when we arrange courier collection, we do not accept responsibility for non-delivery of phones or damage in transit. We therefore recommend that you send any high value units via registered post to ensure successful delivery.

Lost or Stolen Packages

  1. In case of your post being lost, damaged or stolen, you will be required to provide us a proof of postage along with tracking number as this helps in submitting a claim with the carrier.
  2. The value of the claim will not be more than the price offered at the time of sale and under no circumstances do we accept any liability for compensation resulting from the use of our free post services.
  3. If the claim is successful then the claim amount will be paid to the mode of payment selected while registering the sale order.

Payments and Checking Process

  1. We offer and process payments through BACS bank transfer and cheque (Monday to Friday excluding public holidays)
  2. Bank Transfer payments will only be processed to the account details provided while registering your sale order. We cannot, under any circumstances, recall or reissue bank transfer payments once they have been made.
  3. We cannot be held responsible for incorrectly entered bank details and in this case, it can take up to 2 weeks for the funds to be returned to our account to enable us to re-issue the funds. Please note that there is a risk that funds cannot be recovered at all and we cannot take any responsibility for this.
  4. Cheque payment is processed only to the name and address provided while registering your sale order and dispatched through Royal Mail first class.
  5. In case of non-received cheque, we will only reissue in 14 days after original cheque issued.
  6. Under no circumstances payment will be processed before we receive and process your Mobile Phone Market. Typically all orders are processed the same day they arrive however, please allow up to 48 working hours for your Mobile Phone Market to be checked during busy periods including bank holidays, weekends and events outside of our control.
  7. Payments are also subject to validation and security checks which we or third parties may stipulate from time to time.
  8. Once we receive your sale order, our service technicians will check to make sure it is complete and that it meets our terms and conditions. Providing it does, the payment will be processed on the same day, if not, we will send you an e-mail with a revised offer along with the reason towards revised offer and subsequent revised offer payments are processed after your approval.
  9. Please note that we are neither liable nor responsible for any failure to perform or delay in performance of our obligation if it is caused by events outside of our control.

Cooling Off Period

You may cancel the contract with us up until the time you post the Mobile Phone Market ("cooling-off period"), providing:

  1. The contract was negotiated and concluded exclusively by means of distance communication (including, but not limited to, telephone, letter, fax or email); and You are the natural person acting outside the purposes of any business.
  2. When cancelling during the cooling-off period, you need not give us any reason for cancelling the contract, nor will you have to pay any administration charges. To cancel the contract you must notify us in writing.
  3. By sending your Mobile Phone Market, you agree that we may begin work immediately in order to deal with your Mobile Phone Market sale, which may affect cancellation rights and that once you send your Mobile Phone Market to us, your cooling off rights will no longer apply.
  4. We will however return your Mobile Phone Market if, when we receive it, we find that it has a lesser value than originally stated such that we revise the value and you confirm that you do not wish to sell your Mobile Phone Market.

Pricing

  1. Prices offered on our website are subject to change at any time without notice.
  2. Please be aware that we only pay for Mobile Phone Markets listed on our website. Any obsolete mobile phone(s) received will be recycled accordingly.
  3. Once the sale order is registered, the prices quoted are guaranteed for 14 days. If your Mobile Phone Market is received after 14 days from the sale order registered date then updated and current prices will apply.
  4. If your phone does not match your order criteria due to grading or functionality we will contact you with a revised offer. Revised offers will automatically be processed for payment if we do not receive a response within 5 working days.
  5. We will use our reasonable endeavours to provide our customers with the 'Best Price' for their Mobile Phone Markets. However, this is not a guaranteed. We shall not be held liable under any circumstances regarding price pledges.

Sim/Data Cards removal

Please ensure you remove your SIM card before sending us your phone. We are not responsible for any call costs arising before, or after, receipt of your Mobile Phone Market, or arising from any other circumstances whatsoever. You are responsible for cancelling any airtime contract linked to each Mobile Phone Market. All SIM or data cards received by us will be securely destroyed and will not be returned in any case.

Returns Exemptions

  1. In order to try and make the recycling process as fast and efficient as possible, we try to provide as much advice and information as we can. This includes asking customers to deactivate phones from their iCloud account and removing passwords.
  2. It is the customers' responsibility to ensure that the correct information is selected at the point of sale and therefore if the phone received does not match the sales order or we are unable to test a phone because it is either locked to iCloud or has a password preventing us from accessing the phone and you subsequently ask for the phone to be returned to you because you can't remove iCloud or the password for whatever reason, we reserve the right to apply £25 towards returns postal and admin charge to send the item back to you.

Data Risks and Precautions

  1. It is your responsibility to make sure you remove and retain SIM cards and memory cards, all other personal details and data including without limit, address book entries, mobile phone numbers, SMS messages, photographs, games, songs, video and all other data from your Mobile Phone Market.
  2. We take data protection seriously and we do everything in our power to ensure your data is handled and processed securely. As a rule - but without being obligated to do so - we carry out data deletion, resetting to the delivery state and possibly software updates within the scope of our acceptance of goods and testing, which regularly leads to a permanent deletion of existing data.
  3. We will not be in any way responsible for the security, confidentiality, protection, use or disclosure of any personal data that you fail to remove or any losses or costs that arise as a result.
  4. If you send a SIM card, memory card or personal details in error or in reach of this section, we will not under any circumstances be able to return them to you and shall not be deemed to be holding, processing or otherwise using the data on your behalf in any way.
  5. Please also note that if you decide that you don't want to our final valuation price and have your phone returned, all data previously on the phone would have been removed.

Revised offers and Return Policy

  1. If your Mobile Phone Market is eligible for the full website price, the payment will be processed within a day or two to your selected mode of payment.
  2. In case a revised offer is offered for your Mobile Phone Market then we will send an email with a revised offer along with detailed explanation. This email gives two options (1) to accept the final price or (2) to reject the final price and to have your phone returned to you.
  3. If you are not happy to accept, we are happy to return the Mobile Phone Market(s) back to you through Royal Mail. Customers are responsible for the return delivery charges if they want their phones to be returned and we aim to return within 10 working days.
  4. Royal Mail Special Delivery - £10.00. Provides a tracking number and a compensation of up to £500.00 in case of any loss or damage to the post.
  5. Please note, we do not accept any responsibility for non-delivery/loss or damage of Mobile Phone Market(s) being returned back to customer and will not offer any additional compensation apart from what Royal Mail provides.

Activation/Locked Mobile Phone Markets - iCloud & Passwords

  1. We do not accept iOS phones which have not been removed from iCloud, have Find my iPhone turned on or are subject to any other iOS security features.
  2. We also do not accept Samsung phones with Find My Phone activated.

Lost, Stolen, Barred/Blocked/Blacklisted Mobile Phone Markets

  1. Selling a Mobile Phone Market which you do not own is a criminal offence.
  2. We work in accordance to code of practice set by the Home Office and the National Mobile Phone Crime Unit. 'Stop Stolen Mobiles Being Recycled'
  3. We use the CheckMEND (www.checkmend.com) crime protection database for due diligence checks and to ascertain the legal ownership of the phone.
  4. If a Mobile Phone Market is found to have a record that indicates it has been lost or stolen or we become aware of any other issue relating to its ownership, we will notify the seller by email and quarantine the Mobile Phone Market for an initial period of 28 days ("the Quarantine Period").
  5. Payment for the Mobile Phone Market will be withheld by us until the CheckMEND record does not show the Mobile Phone Market as stolen or lost.
  6. In such circumstances you will be required to contact CheckMEND to prove that you are the rightful owner of the Mobile Phone Market and have the lost or stolen records associated with it cleared within the Quarantine Period and/or resolve any other issue relating to its ownership.
  7. If during the Quarantine Period the Mobile Phone Market is cleared on the CheckMEND database and any other issue relating to ownership of the same is resolved, your sale will be processed and paid for as normal.
  8. However, where the Mobile Phone Market is not cleared on CheckMEND within the Quarantine Period, we will be required by law to hold onto the Mobile Phone Market pass it to the Police or other law enforcement body or dispose of it, and by entering into this contract, you expressly agree to this action.
  9. If you have received payment from us for a Mobile Phone Market which we subsequently become aware of an issue relating to ownership, you agree to immediately reimburse us in full, within 3 business days following a written request by us, for any such payment pending an investigation by us or any law enforcement body into ownership of the Mobile Phone Market. You may also be contacted by the Police and/or other law enforcement authorities.
  10. By entering into this contract you agree to us supplying data to the police or other authorised bodies (such as, but not limited to, network operators and insurance companies) for the purpose of the prevention and detection of crime, arrest and prosecution of offenders or for the recovery of stolen property.

Bulk Orders

Bulk orders are processed within two to three working days and the price offered varies to the website price depending on the quantity and condition of the phones. Please contact our customer centric customer care for any further information.

Fake and Counterfeit Phones

Fake and counterfeit phones are manufactured to resemble phones made by another company which is a breach of Copyright. We do not accept fake or counterfeit phones for recycling for cash. Fake/counterfeit phones will not be returned in accordance with industry Copyright practice and standards. They will be disposed of with no payment due.

Wrong Models and Testing

As Mobile Phone Markets can look similar, they at times will be incorrectly identified. If we find that the Mobile Phone Market you sent is not as referred to in your sales order, we will email a value for the actual Mobile Phone Market, confirming the model. You can choose to continue the sale for the revised value or decline it. To accept or decline a revised value you will have to reply back to the revised offer email you received, or contact us via telephone. If you do not respond within 5 days, starting on the day on which we email the revised value, we will automatically process your sale after that time, using the new price.

Events outside of our control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control or due to our compliance with any applicable laws or regulations.

Emails

We will regularly send you order updates by email. We advise you to check your emails as well as junk folders frequently for any important information about your order. We cannot accept responsibility for any emails which are not received successfully by you or by us due to the incorrect input of email address or spam filter intervention.

Limitation of Liability

To the extent that we are liable to you for breach of contract, negligence or any other liability arising under these Terms and Conditions, our liability shall at all times be capped at the Valuation of the Item(s) which is the subject of your claim. We shall not be liable for any special indirect, punitive, incidental, special or consequential damages relating to your Contract with us. This includes but is not limited to direct and indirect loss of profit and loss of income. We are not liable and cannot be held responsible for any unforeseeable loss or damage that may occur to you or any third party. Nothing in these terms and conditions limits our liability for death or personal injury caused by negligence, fraud, misrepresentation or any other liability which cannot be legally excluded or limited.

Indemnification

You agree to defend, indemnify and hold us harmless for any loss, damages or costs; its advertisers, licensors, subsidiaries and other affiliated companies and their employees, contractors, officers, agents and directors from all liabilities, claims, and expenses, including attorney's fees, resulting from your use of the website or the Site Content or your breach of these terms and conditions, including without limitation any third party claim, action or demand. We hereby reserve all our rights at our expenses, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which you shall cooperate with us in asserting any available defence.
